Disputes with GamerHuddle
“Claim” means any claim (past, present or future), dispute, disagreement or controversy by and between any Members, Commissioners or Events (including, but not limited to, Member, Commissioner or Events account(s)), this Agreement, these Terms, or any relationship or agreement you have or had with GamerHuddle, except for the validity, enforceability or scope of this Arbitration provision; and
“you” or “your” means Members, Commissioners, and any affiliates or related persons or entities individually.
If you have a concern with GamerHuddle and/or its services, please contact GamerHuddle first. We will make every effort to listen to your concerns and address them in a timely, cost-effective manner. If you and GamerHuddle are unable to reach an agreement, GamerHuddle in its sole discretion can, but has no obligation to, consider the merits of using mediation services in Placer County, California.
Before initiating action to enforce a claim, you and GamerHuddle hereby agree to provide a written notice (a “Notice of Claim”) in the manner described in this Agreement to each person or entity against whom a Claim is against. The Notice of Claim must describe the claim and specify the relief sought. Notice to GamerHuddle must include your name, address, Event Commissioner and Event name.
EXCEPT AS OTHERWISE NOTED, YOU AND GAMERHUDDLE HEREBY AGREE TO RESOLVE ALL CLAIMS THROUGH BINDING ARBITRATION ONLY. YOU UNDERSTAND THAT BY THIS AGREEMENT YOU ARE WAIVING THE RIGHT TO BRING A CLAIM IN COURT OR BEFORE A JURY OF YOUR PEERS.
Claims will be handled by a single arbitrator appointed by the American Arbitration Association (“AAA”) and pursuant to the AAA’s Consumer Arbitration Rules in effect at the time the claim is filed, except where those rules conflict with this Agreement. Claimants can contact AAA by calling their toll free number (800-778-7879) or visiting www.adr.org. Any arbitration under this agreement will be held in Placer County, California. GamerHuddle will not elect arbitration for any Claim filed in small claims court with jurisdiction over GamerHuddle, as long as the claim is individual and pending only in that court. You or GamerHuddle can require arbitration of any Claim at any time unless the Claim was originally filed in court and trial has begun or final judgment entered.
YOU HEREBY AGREE THAT NO CLASS, COLLECTIVE, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL CLAIMS WILL BE ALLOWED OR HEARD IN ANY ARBITRATION OR SUIT HELD UNDER THIS AGREEMENT.
Claims will be arbitrated on an individual basis only. You and GamerHuddle agree that the authority of the arbitrator is limited to individual claims between you and GamerHuddle alone. Subject to the limitations of this Section, the arbitrator will have authority to award legal and equitable relief available in the courts of the State of California, except the arbitrator shall not have the authority to award punitive damages. Any questions regarding the enforceability or interpretation of this Section shall be decided by a Court with jurisdiction and not by the arbitrator.
The Federal Arbitration Act governs the arbitration requirements and provisions herein. The arbitrator’s award will be binding and final upon both GamerHuddle and you, except for any right of appeal provided by the FAA; provided however, a written notice of appeal must be delivered within 30 days after the issuance of an award by the arbitrator to the arbitrator organization and all parties to the arbitration. Judgment upon any award may be entered in any court having jurisdiction.
You will be responsible for paying your share of arbitration fees, including, but not limited to, filing fees, administrative fees, and hearing or other fees. Should you bring an action regarding a Claim other than as provided in this section, you will be liable for the attorneys’ fees, costs and expenses incurred by GamerHuddle in connection with enforcing this Agreement.
This section will survive termination of your Account, voluntary payment of your Account balance and any legal proceeding for bankruptcy and/or debt collection.
Your use of the site and services of GamerHuddle, and subject to the limitations contained herein, is conditioned on your agreement that any dispute brought against GamerHuddle may only be made by commencing legal action (arbitration) in Placer County, California and that California law applies to all such disputes and claims. In any dispute where GamerHuddle is successful in the outcome, GamerHuddle shall be entitled to recover all of its costs and expenses associated with the dispute, including, but not limited to, attorneys’ fees and court costs. Any dispute brought against GamerHuddle contrary to these Terms is considered a breach of these Terms and GamerHuddle is entitled to recover all costs associated with the dispute and/or claim, including but not limited to attorneys’ fees and costs.
Any action or choice to take no action, by GamerHuddle in relation to any claim or dispute, does not waive GamerHuddle’s right to act in any fashion in any subsequent situations regardless of their similarities.

ENDORSEMENTS AND SPONSORSHIPS
GamerHuddle is not sponsored or endorsed by any sporting association, player, or players’ association. Should any of these entities appear on the GamerHuddle website, it is not offered as an endorsement or sponsorship of said entity by GamerHuddle.
Game of Skill Offerings
GamerHuddles customizable interface provides services such as: H2H Wagering in League Play, Leagues Entry Fees for Season Contests, Daily Fantasy Sports, Fantasy Sports Leagues, Guaranteed Prize Pools, Fifty-Fifty Events, H2H Fantasy Sports Matches, & Private Fantasy Sports Leagues & Pools. An Events payout structure cannot be changed after the first payment is made.
No winning outcome is based: a) on the score, point spread, or any performance or performances of any single real-world team or any combination of such teams; or b) solely on any single performance of an individual athlete or contestant in any single real-world sporting or game of skill event.
Events rules are defined by the challenge sent to a prospective contestant or a commissioner of a league(s) or event(s) you compete in. Prior to entering an event, it is the responsibility of the player to acknowledge the rules. It is also the responsibility of the commissioner to provide contestants the league rules, settings used, and wagering structure prior to any member joining an event.
It is common that members of an event or league may not be able to align prior to each advance of an event or week of a season. GamerHuddle does not allow for Wager Leagues to award a “Force Win” in a scenario where schedules will not align. In these scenarios, the game will either be a “fair sim” meaning CPU vs CPU simulation, or the available party to play will play the unavailable parties “Auto Pilot” or vs their CPU. It is not fair for free wins or losses to be given out in a wagering platform due to scheduling issues, when the other members of the league are engaging in competition for their wins or losses. Also in this scenario, injuries and all other league rules will be applicable during a sim.
It is also not realistic to expect that lag/poor connection or server issues will not occur. If lag issues are occurring, the game must be exited prior to any scoring plays, or the opponent having the ball past their opponent’s 35 yard line. If disconnections occur, the team that was up can request the game be played with the scenario that was left off when the game disconnected. It will be the team leadings decision to recreate the previous scenario, play a game with the closest time remaining rounded up or down per quarter, or restart the game from the beginning. If the game restarts and there was agreement on recreation of the game, then it will be a fresh restart/replay. If a scenario occurs where a game was replicated, and the losing team cannot concede after the 2nd half by being down. The commissioner will be required to set the Force Win for the victor.
If a member chooses to not follow the above policies, they are subject to removal of the league and forfeiting their league fees and/or peer to peer wagering monies.
To ensure that there is evidence and witnesses that can attest to any foul play in an Event or League you compete in, it is recommended that you stream your games. Your commissioner will need proof of any foul play for them to take action. The streaming options are: www.twitch.com
Code of Conduct
It is the responsibility of the member to read and fully understand the Wager League Disclaimer. Any attempt to artificially give someone wins or losses is prohibited. Impersonating or attempting to impersonate another player in any way is prohibited.
Setting up matches with the intent to do anything but participate in a game of skill is a violation of Wager League policy. Any instance will result in potential removal of a league at the commssioners discretion and/or probation or suspension from GamerHuddle to compete in Wager Events.
Accessing or playing games on another players account is prohibited. Anyone found to have accessed another player’s account or allowed another player to access their account without acknowledgment from the opponent and the commissioner that this is acceptable, is reason to be removed from a Wager Event or League and/or probation or suspension of entering Wager Leagues.
If you are cited for intentional lagging, your account will be closed.
In salary cap contests, participants will create a lineup by selecting players listed in the Player Pool.
Contest results will be determined by the total points accumulated by each individual lineup entry (scoring rules summarized below).
Shown on the site.
Lineups will consist of 9 players and must include players from at least 2 different NFL games. The 9 Roster positions are:
The Player Pool will consist of all NFL players expected to be on the active roster for any team scheduled to play in the contest in the NFL Simulated Season. Occasionally a player may be missing from the Player Pool due to trades, injuries, and/or or other unforeseen circumstances. Each player listed in the player pool has an assigned salary and a valid lineup must not exceed the salary cap of $50,000.
Due to the fluid nature of rosters, in the event a team adjusts their roster after player pools are finalized, GamerHuddle reserves the right to adjust player pools after contests for that Game Set have become available. In these instances, additional players may be added to the Player Pool up until 48 hours before a Game Set’s lock. This may result in valid lineups becoming invalid. Any participants who have entered contests for the Game Set prior to the adjustment will be notified via email.
A "Game Set" is a set of games used for contests; each contest is tied to one Game Set. Contests tied to the same Game Set can be created at different times. Therefore, game policies are based on the timing of a Game Set being made available, not each individual contest.
Player positions are determined at the sole discretion of GamerHuddle.
Lineups may be edited at any time leading up to games. Each individual player will become "locked" at the scheduled start time of their team’s game. A locked player cannot be added or removed from a roster spot. Locked roster spots for all entries are displayed in contest GameCenters.
If the scheduled start time for a game changes after contests for a Game Set containing that game become available, GamerHuddle will take measures to ensure the change is reflected on Draft Screens and for lineup editing purposes. In the rare case that a game starts before the scheduled start time, all players within that game will become locked as soon as our feed reflects that the game has begun. Additionally, any swaps that were made after the real-life start time of the game will result in those lineups being disqualified and refunded.
In the event that a game is cancelled or postponed & rescheduled to a time within the original Scoring Period and this change is made less than 24 hours before a Game Set’s start, the game will be included in the Game Set and players listed to play in that game will be eligible to accrue points.
If a game is rescheduled for a time OUTSIDE the original Scoring Period and this change is made less than 24 hours before a Game Set’s start, the game will be disabled from the Game Set and players listed to play in that game will NOT be eligible to accrue point. Players who you selected for your roster as of the time of the lock of the disabled game will remain in your roster and will accrue zero points. Players in disabled games will become locked at the originally scheduled start time of their game.
The Scoring Period for NFL is defined as the timeframe between the scheduled start of the first game within the Game Set and 11:59pm ET on the first Wednesday after the last scheduled game within the Game Set. In the event that a game is cancelled or postponed & rescheduled to any time (both outside & within the original Scoring Period) and this change is made MORE than 24 hours before a Game Set’s start, it is at the sole discretion of GamerHuddle to include or remove the game from that given Game Set.
In the event a game is postponed, GamerHuddle will make a decision no later than 11:59pm ET of the day of the game on how to handle the postponed game.
GamerHuddle may choose to adjust the Scoring Period for a Game Set at their sole discretion to accommodate schedule changes to any time before 12:00am ET on the day after the Game Set is scheduled.
Any games that are disabled will be indicated as such on Draft Screens. Emails and other notifications may also be used to notify users of disabled games.
If canceled or rescheduled games result in a Game Set including only one active game and this is known before the contest start time then all contests for that Game Set will be canceled and refunded.
If a Game Set includes only one active game but this was not known until after the contest start time then contests for this Game Set will not be canceled.
Games are "known" to be canceled or postponed once their status is updated as such by GamerHuddle.
Example: If a Game Set includes two games at 8pm ET and 10:30pm ET respectively, and the 10:30pm ET game is officially postponed at 6pm ET then all contests for that Game Set are canceled and refunded. If the 10:30pm ET game was not officially postponed until after 8pm ET then contests for that Game Set are not canceled and are played out using only the one active game.
If canceled or rescheduled games result in a Game Set including zero active games, all contests for that Game Set will be canceled and refunded.
GamerHuddle uses official NFL statistics and only includes statistics from games NFL deems to be official. If the NFL declares a game "suspended" then the statistics generated before the game is suspended will count in Game Sets containing said game. Any statistics generated on a later date when the game resumes will not be included.
Games are available for viewing in Game Center under the submitted lineup. Additional streams can be found inside the GamerHuddle …
In the event of a game malfunction, all Game Sets with the affected match up will be cancelled and refunded. A game malfunction is defined as any malfunction that prohibits the game from finishing. There are rare instances in which there may be a malfunction of the GamerHuddle stream, but the game itself remains unaffected. In these cases, the streams will be Re-Connected. GamerHuddle will publish the box scores of these contests, and all scores will be considered final after confirmation of all scoring plays and turnovers by our operations team.
